This is the first time we're seeing Lindsay Clancy since the mistrial was declared.

Judge William Sullivan begins by discussing the motions before the court.

That include a renewed motion for a required finding, a motion to preserve juror records and an enquiry into "Juror Doe", meaning the lone juror.

Lindsay Clancy is now back in court for the status conference in the case against her.

We’re now seeing a picture of a Plymouth County Sheriff’s van arriving at court.

It is apparently the same van Clancy was taken into when she came out of court each day and her supporters can be seen waving at it.

While our wait continues, we have also learned that the prosecution team have filed a motion to "preclude prejudicial extrajudicial statements to the media", also known as a gag order.

The motion argues that Clancy's lawyer, Kevin Reddington, has been actively speaking to the media and commenting on issues such as how the defendant was doing and feeling, and how witnesses testified.

Reddington has also spoken about the jurors deliberating in the case, which the motion describes as "most disturbing". On 3 September, the motion says, Reddington referred to the "hold out juror" as "he", and "ensured that the juror would be publicly identified".

The prosecution says the court should therefore "limit the extrajudicial statement made in this case to ensure the fair administration of justice".

We are still waiting for proceedings to begin, but expect Lindsay Clancy to appear in court soon.

I spent days in the Massachusetts courthouse where we're expecting to see Lindsay Clancy today, for the first time since a mistrial was declared in her murder trial.

There's room for a few dozen members of the press - seats which, given the spectacle that has surrounded this case, will likely be full.

There's also spaces for Clancy's family and friends who were often seen sitting in the wooden benches behind her.

And there's even room for some members of the public to watch.

Since the last time all of these people were in the courtroom together, we've learned a lot more about the jury that could not reach consensus.

I expect we'll hear more about those 12 individuals today as we potentially learn what happens next in this case.

We're still waiting for the court to start in Plymouth, Massachusetts; we saw Clancy's lawyer arriving a little earlier.

The hearing was expected to begin at 09:00 EDT (14:00 BST), so is running a little late.

The central question of Clancy’s trial was whether or not she was criminally responsible at the time of her children's deaths.

Prosecutors say she acted intentionally, while the defence argued that the 36-year-old mother was in the grip of severe postpartum psychosis and could not understand the consequences of her actions at the time.

In part, this case centres around this rare, but severe, condition. With postpartum psychosis, patients can experience mania and depression, as well as psychotic symptoms like delusions. In rare cases, people experiencing the condition may harm or kill themselves or other people.

But unlike postpartum depression, it is not classified in the DSM-5 - the main guide that US medical practitioners use to diagnose mental health conditions.

The absence of a clear, standardised DSM-5 definition of postpartum psychosis meant that the defence struggled to show Clancy's psychotic state met a specific criteria.

Cora Clancy was a “girly girl” who loved princesses and caring for others, according to testimony from her father, Patrick Clancy, and the family’s former nanny Elaine Rossi.

Rossi testified that the five-year-old loved arts and crafts and liked to play with her toy supermarket playset.

"She just liked taking care of people," her father said.

Dawson

Dawson was into firefighters, trucks, and the TV show Paw Patrol, his father and Rossi told the court.

His former nanny described the three-year-old as “full of energy, rambunctious”.

Callan

Callan was described by his father and his nanny as an even-tempered baby.

"He was the happiest, sweetest, easiest baby,” Rossi said of the eight-month-old.

Also seen outside court are Clancy's parents, Michael and Paula Musgrove.

Michael Desronvil, the lone holdout juror who wanted to convict Clancy of murder, says he knows the focus is on him, but wants to turn it back to the three children who "can't speak for themselves" and "can't fight the battles".

In a video clip broadcast on Fox News, he also says he wants to thank God for his Catholic faith and thank everyone who has supported him throughout this "difficult situation".

"Your prayers, your emotional support, psychological support, is tremendous to my heart," he says. "I do want to thank you from the bottom of my heart."

He does not say any more about his thoughts on the case or the decision he made.

As we mentioned earlier, prosecutors have yet to say whether they will retry Lindsay Clancy.

Here are the options they could pursue today:

• They could retry her on the same first-degree murder charges, triggering another jury trial
• They could retry her on reduced charges of either second-degree murder or manslaughter - Clancy could then waive her right to a jury trial, allowing a judge to decide her fate in a bench trial
• They could drop the case altogether
• They could reach a plea deal

It’s also possible they won’t announce a decision today and will say they need more time to assess the options.

Several jurors have spoken publicly about the case since it ended in a mistrial earlier this month, something all jurors are entitled to do when a trial ends.

They’ve told US media that the deliberation room was filled with “big personalities” and “tears”. They also said the panel was ready to enter a verdict of not guilty by reason of insanity - but one juror would not agree.

"I was so sad, so sad that we couldn't come up with a verdict for Lindsay. It was so heartbreaking," said the jury’s forewoman, a retired fifth-grade teacher, to Boston’s local NBC10.

Michael Desronvil, who came forward as the lone holdout, said in a statement to the BBC’s US partner CBS News that there was no doubt in his mind that Clancy was guilty of murder.

"Based on all the physical evidence, key witnesses and what the prosecution presents, I thought it was enough proof that she knew exactly what she was doing and planned it," he said.

Another juror told local CBS station WBZ-TV that the majority of the jurors were "very firm in their stance" from the beginning and "the stand-alone juror was not the only one that was unwilling to see things from the other side".

After seven days in the deliberation room, the jury - nine women and three men - failed to reach a verdict.

In multiple notes to the judge, the jurors revealed an 11-1 spilt.

Twice, the judge sent the jury back to deliberate despite the deadlock.

In a final note on 4 September 2026, the jury forewoman wrote: “It is with a heavy heart that we cannot come to a decision and will not be able to.”

The judge declared a mistrial.

Multiple jurors have since spoken to the media, confirming the majority accepted Clancy’s postpartum psychosis defence. The one juror who disagreed said Clancy “knew exactly what she was doing".

Lindsay Clancy is a 36-year-old Massachusetts mother and former labour and delivery nurse who has admitted to killing her children, Cora, 5, Dawson, 3, and Callan, who was eight months old, in January 2023.

Clancy was charged with first degree murder, which is punishable by life in prison, but pleaded not guilty by reason of insanity. Her defence team argued she was suffering postpartum psychosis when she strangled her children and should not be found criminally responsible.

Lindsay Clancy’s ex-husband, mother, mother-in-law and psychiatrist all gave evidence.

Lindsay Clancy’s defence team has filed multiple motions since her trial fell apart earlier this month.

Her lawyer, Kevin Reddington, wants the judge to investigate the lone juror that wanted to convict Clancy of murder, including by looking into calls and texts he made during deliberations.

A lawyer for the juror has said the latest defence motion was a "Looney Tunes" attack on his client for doing his civic duty. The juror, Michael Desronvil, has said there was "enough proof that she [Clancy] knew exactly what she was doing".

In a separate motion, Reddington is also asking for the case against Clancy to be dismissed entirely, arguing that a retrial would violate double-jeopardy protections that prevent someone from being tried for the same crime twice.

Prosecutors have yet to say whether they will retry her.

Lindsay Clancy is back in court today for the first time since her murder trial ended in a hung jury earlier this month.

The 36-year-old mother has admitted to strangling her three children in the basement of her Massachusetts home in January 2023 before attempting to take her own life.

She pleaded not guilty to murder by reason of insanity, with her lawyers arguing she was suffering from postpartum psychosis at the time of the killings, while state prosecutors say she methodically planned the killings.

After a five-week trial and seven tense days of deliberation, a jury could not come to a unanimous verdict and Judge William Sullivan declared a mistrial.

The defence is now asking the judge to investigate the lone juror who wanted to find Clancy guilty - and use his powers to dismiss the case. State lawyers could also retry Clancy (though they have not announced their intentions to do so yet).
